A Queens mother — still haunted by the memory of finding her daughter dead in bed four years ago — finally has a shot at justice. A DNA match has linked a man already behind bars upstate to the 2009 rape and murder of Carmen Saldana, a stunning 23-year-old student at the Fashion Institute of Technology. Restaurant worker Jose Martinez, 30, confessed to choking Saldana to death and has been indicted on murder and rape charges, sources said. He is expected to be arraigned Thursday — and Saldana’s mom will be there watching. Martinez also faces charges of kidnapping, burglary, unlawful imprisonment and criminal possession of stolen property. Jose Martinez, 30, will be charged Thursday in the 2009 rape and murder of Carmen Saldana. Martinez is currently in upstate prison on unrelated charges.

A Bronx teenager who wounded an 8-year-old boy in a bicycle-by shooting apologized Tuesday to the victim and his mother.
But 17-year-old Eduardo Rodriguez was “too nervous” to read his handwritten apology himself, his lawyer said.
And neither shooting victim Armando Bigo nor his mom was there to see the pigtail-wearing prisoner sentenced to 2.5 to 7.5 years in prison.
“First and foremost, I apologize for what happened to your son, Armando. I did not mean any harm, but I also feel very bad and sad about what happened to Armando," Rodriguez’s court-appointed lawyer, Amy Galicchio, read from the letter.
“I think about it every night, and I say to myself, 'I should have never did what I did in the first place.’ I think about it as that could have been my little brother and if somebody would have did that to my little brother, I would have felt real bad.”
Rodriguez’s statement was read shortly after Assistant District Attorney Leah Takantzas conveyed a message to the court from Bigo’s mom, Elys Flores. She said Armando suffered a fractured left rib and a lacerated lung and that Rodriguez's errant slug is still lodged in his body.
